1. What is SB407 and how will the City apply the legislative requirements of this bill?

Senate Bill 407 Padilla (2009) On or after January 1, 2014 requires that all noncompliant plumbing fixtures be retrofitted with water-conserving plumbing fixtures in single family residential real property, multifamily real property, and commercial real property which includes a hotel and motel that is not a single-family residential real property or multifamily residential real property requiring a building permit for alterations or improvements. There are several exceptions to the requirement, please see the Building Division for the correct application of the provisions specific to the scope of your project.

California Building Officials (CALBO) made an interpretation on how to apply these legislative requirements (when it comes to home repairs that also require permits by City codes). This legislative analysis is a result of the work of CALBO; furthermore it is how the City of Pismo Beach will apply the legislative requirements. The analysis by CALBO, as followed by the City, will aid the public in retaining the ability to maintain their properties without the requirement of retrofitting their plumbing fixtures; which will curtail permit avoidance and assist property owners in obtaining the proper permits for their repairs.

Noncompliant plumbing fixtures are defined as:
1. Any toilet manufactured for use more than 1.6 gallons of water per flush
2. Any urinal manufactured for use more than 1 gallon of water per flush
3. Any showerhead manufactured to have a flow capacity of more than 2.5 gallons of water per minute
4. Any interior faucet that emits more than 2.2 gallons of water per minute

Water-conserving plumbing fixture is defined as;
Any fixture that is in compliance with current building standards applicable to a newly constructed real property of the same type.

2. Why do I need a building permit?

The issuance of a building permit ensures that appropriate plans have been reviewed and the resulting construction is inspected to satisfy local, State and Federal requirements to safeguard the public health, welfare and safety. These requirements include building construction codes for fire and earthquake safety, energy conservation codes, and zoning codes.

3. How long will it take to get a Building Permit?

Depending on the scope of work proposed, it could be an over-the-counter permit or take up to six weeks or longer depending on Design Professionals. The Building Division’s goal is for a 15-day turnaround for the first review and 5-day turnaround for each additional review.

4. What is an Owner-Builder?

The term “Owner-Builder” can mean three different things: 1)“Owner as Worker”, 2)“Owner as Contractor” or 3)“Owner as Employer”.

5. I want to remodel my kitchen. Will I have to bring the whole house “up to code?”

No. Your work will be limited to the area(s) shown on the approved plans. For example: If you modernize the kitchen with new wiring, you would not be required to re-wire the entire house.

6. I recently purchased a house which had work done without a permit. I also have performed further work without obtaining permits. Will everything have to be ripped out?

7. Are there regulations concerning the use of streets and sidewalks for the placement of construction-related vehicles and material?

8. What happens if I do not obtain a building permit?

Property owners who build or remodel structures without obtaining the necessary permits are in violation of the Uniform Building Codes and various ordinances. They may be required to remove the structure. Unless the structure is removed, approvals are still required. Upon sale of the property, you must disclose any work that has been done without the benefit of required permits. This could jeopardize the sale of your property.

9. How much will my permit cost?

11. How do I obtain a re-roof, plumbing, electrical or mechanical permit?

The new codes will be effective January 1, 2014 and will govern all projects that are submitted for plan check on or after the effective date.
